This article has a threefold purpose:
First, we describe the rise of 'gig' work in the United States and the implications of considering gig workers as "independent contractors" (e.g., mandating the use of private arbitration for business disputes.
Second, we recount various legal classification systems for distinguishing between "employees" an "independent contractors," emphasizing collective bargaining rights and seminal cases decided by the National Labor Relations Board.
Finally, we consider alternative proposals pertaining to independent contractors.
The intention is that managers, company owners, legislators, and other interested readers will develop their foundational knowledge in these areas.
